Probate: Probate is a transaction involving the courts for distribution of assets, including real estate, by will or by law if there is no will. Trust: A trust, is a legal arrangement to ensure a person’s assets go to specific beneficiaries. The trust creator sometimes also known as Grantor, creates a Trust in order to distribute assets within the trust and authorizes a trustee to administer those assets for the trust creator or beneficiaries. A Beneficiary is a person who eventually receives some or all the assets in the trust. The Trustee is the person designated to follow and administer the trust. Will: A will is a document that contains your direct wishes for your property and assets, as well as the care of your dependents. It is the only way to make sure your money, property, possessions and investments are distributed according to your wishes. A deceased with no will could cause family issues or strife or may be left in the hands of judges or state officials. Enhanced Life Estate Deed: also known as an Enhanced Life Estate Deed, is a type of real estate deed that some individuals use to transfer property upon death outside of probate. It is frequently used to help avoid probate court proceedings while allowing the property owner to retain control during their lifetime. Private note and mortgage: Sellers sometimes will finance a portion of the sales for the buyer. We are able to prepare this note and mortgage to be executed at closing.
